Hilltop Platform Terms

These Platform Terms govern your use of Hilltop.
Hilltop is a visual media library that connects to Google Drive and helps professional users organise, browse, search and understand their media.
Hilltop is operated by Damien Attenborough, trading as Hilltop, in the United Kingdom.
By creating an account or using Hilltop, you agree to these terms.

1. Who can use Hilltop
Hilltop is intended for businesses and professional users aged 18 or over.
You may use Hilltop:
- for your own professional or business purposes; or
- on behalf of an organisation that has authorised you to do so.
If you use Hilltop on behalf of an organisation, you confirm that you have authority to accept these terms on its behalf.
Hilltop is not currently offered as a consumer service.
2. The Hilltop service
Hilltop provides tools for organising, viewing, searching and understanding media held in connected services such as Google Drive.
Hilltop may provide features including:
- importing and indexing selected media;
- generating previews;
- tags, albums and boards;
- notes and other organisational information;
- image descriptions and search metadata;
- video and audio transcription;
- search and discovery features.
Hilltop is designed as an organisational and discovery layer over your existing storage.
Hilltop is not intended to be your primary or sole backup or storage location for original media.
Your original Google Drive files generally remain in Google Drive.
3. Early access
Hilltop is currently an early-access service.
Anyone may apply for access, but accounts are currently made available by invitation.
There is currently no charge for using the early-access service.
During early access:
- features may change;
- functionality may be added or removed;
- parts of the service may occasionally be unavailable or contain errors;
- we may impose reasonable usage limits;
- we may reset, migrate or discontinue parts of the service where reasonably necessary to develop or operate Hilltop.
Where reasonably possible, we will try to give users advance notice of changes that could materially affect their stored Hilltop data.
We will not intentionally delete or reset customer data without a reasonable operational, security or legal reason.
4. Your account
You are responsible for:
- keeping access to your Hilltop account secure;
- ensuring information you provide is reasonably accurate;
- ensuring people using your organisation's Hilltop workspace are authorised to do so;
- notifying us if you believe your account has been compromised.
You must not allow another person to use your account in a way that breaches these terms.
5. Connecting Google Drive
Hilltop uses Google authentication and Google Drive APIs to provide its core functionality.
When you connect Google Drive, you authorise Hilltop to access the Google information and content covered by the permissions you grant.
You remain responsible for your Google account and for ensuring you have permission to access and process the files you make available through Hilltop.
Hilltop does not take ownership of your Google Drive content.
Hilltop will not intentionally move, edit or delete your original Google Drive files as part of its normal media-library functionality.
If you revoke Hilltop's Google access, disconnect your account, or Google otherwise prevents access, some Hilltop functionality may stop working.
Google Drive and other Google services are provided by Google under Google's own terms and policies.
6. Your content belongs to you
You and your organisation retain ownership of the files, media, notes and other content you provide or make available through Hilltop.
You give Hilltop a limited, non-exclusive right to access, copy, process, transform and transmit that content only as reasonably necessary to provide, secure, maintain and support Hilltop, or where required by law.
For example, this allows Hilltop to:
- retrieve selected media from Google Drive;
- create and store previews;
- extract metadata;
- generate transcripts and image descriptions;
- index content for search;
- display content to authorised members of your workspace;
- send content to service providers where required to provide a feature.
This permission lasts only for as long as Hilltop reasonably needs the relevant content to provide the service, subject to legal or security requirements described in our Privacy Policy.
7. Your responsibility for content
You are responsible for the content you choose to process through Hilltop.
You confirm that you have the rights, permissions and lawful basis reasonably required to:
- access that content;
- use it for your professional or business purposes;
- make it available to Hilltop for processing;
- allow Hilltop to provide the features you choose to use.
This may include obligations relating to copyright, confidentiality, privacy, data protection and rights relating to people depicted or recorded in media.
Hilltop does not independently determine whether you have those rights.
8. AI-powered features
Some Hilltop features use artificial intelligence, including image analysis and transcription.
Hilltop currently uses selected third-party AI providers to perform some of this processing.
Hilltop does not use customers' private files or customer data to train AI models.
We aim to select and configure AI providers with appropriate privacy, retention and model-training practices.
AI-generated outputs may contain mistakes, omissions or inaccurate interpretations.
You should treat generated descriptions, transcripts, classifications and search information as aids to organisation and discovery rather than authoritative statements about people or content.
9. Acceptable use
You must not use Hilltop to:
- break applicable law;
- process content you have no right to access or use;
- infringe another person's intellectual-property, privacy or other rights;
- access another user's account or data without permission;
- circumvent authentication, permissions or security controls;
- probe, scan or test Hilltop for vulnerabilities without permission;
- introduce malware or malicious code;
- intentionally interfere with or overload the service;
- use automated systems to access Hilltop in a way that creates unreasonable load or circumvents normal product limits;
- reverse-engineer or attempt to extract Hilltop source code except where applicable law expressly permits this.
We may suspend or restrict access where we reasonably believe use of Hilltop poses a security, legal or operational risk.
10. Data processing for professional customers
This section applies where Hilltop processes personal data contained in customer media or other customer content on behalf of you or your organisation.
For that processing, you are the controller and Hilltop acts as a processor, unless applicable data-protection law requires a different classification.
Your instructions
Hilltop will process that personal data only:
- to provide the Hilltop service you choose to use;
- according to your documented instructions, including your use and configuration of Hilltop;
- as described in these terms and the Privacy Policy; or
- where required by applicable law.
If we are legally required to process data outside your instructions, we will tell you where the law allows us to do so.
Nature of the processing
The processing may include retrieving, transmitting, organising, storing, indexing, displaying, analysing and deleting personal data contained in customer media.
It may include:
- images and video;
- audio;
- names and other information contained within media;
- filenames and metadata;
- notes and tags;
- transcripts;
- image descriptions and search metadata.
The people whose data may be processed depend on the content you choose to use with Hilltop and may include your staff, customers, suppliers, contributors, members of the public or other individuals depicted or recorded in media.
Processing continues for as long as required to provide Hilltop to you or until the relevant data is deleted, subject to applicable legal obligations.
Confidentiality and security
We will ensure that anyone authorised by Hilltop to access customer personal data is subject to an appropriate duty of confidentiality.
We will maintain reasonable technical and organisational security measures appropriate to the nature of the service and the data being processed.
Service providers and subprocessors
You authorise Hilltop to use service providers to process customer personal data where reasonably necessary to operate the service.
Current principal providers include:
- Google;
- Supabase;
- Vercel;
- Moondream / M87 Labs;
- ElevenLabs;
- Sentry, for error/performance monitoring;
- PostHog, for product analytics;
- Resend, for transactional and service email delivery.
Hilltop will require subprocessors handling personal data on our behalf to be subject to appropriate data-protection obligations.
We remain responsible for our obligations concerning the subprocessors we appoint.
We may change service providers as Hilltop develops. Where a change is likely to materially affect how customer personal data is processed, we will provide reasonable information about that change.
International transfers
Some providers may process personal data outside the United Kingdom.
Where UK data-protection law requires safeguards for an international transfer, Hilltop will take reasonable steps to ensure an appropriate transfer mechanism is in place.
Helping you meet data-protection obligations
Taking into account the nature of Hilltop and the information available to us, we will provide reasonable assistance where needed to help you:
- respond to individuals exercising their data-protection rights;
- meet applicable security and personal-data-breach obligations;
- conduct a data-protection impact assessment where relevant to your use of Hilltop;
- respond to reasonable regulatory requirements relating to Hilltop's processing.

Ending processing
When relevant customer data is deleted from Hilltop or your use of the service ends, Hilltop will delete or return personal data processed on your behalf where reasonably required by applicable law and your instructions, except where retention is required by law.
The current deletion and retention approach is described in the Hilltop Privacy Policy.
Compliance information
We will make information reasonably necessary to demonstrate compliance with these data-processing obligations available to professional customers where required by applicable data-protection law.
Any inspection or audit request must be reasonable, proportionate, relevant to Hilltop's processing and arranged with reasonable notice.
11. Hilltop intellectual property
Hilltop and its underlying software, design, branding, interfaces, documentation and technology belong to Hilltop or its licensors.
These terms do not transfer ownership of Hilltop's intellectual property to you.
We give you a limited, non-exclusive, non-transferable right to use Hilltop for your professional or business purposes while you have access to the service and comply with these terms.
12. Feedback
We welcome feedback about Hilltop.
If you give us suggestions, ideas or feedback, you allow us to use them to develop and improve Hilltop without an obligation to compensate you or treat the feedback as confidential.
This does not give Hilltop ownership of your underlying customer content.
13. Third-party services
Hilltop relies on services provided by other companies, including Google, Supabase, Vercel and AI providers.
Those services may occasionally:
- be unavailable;
- change their APIs or functionality;
- change limits or requirements;
- experience outages or security incidents;
- withdraw or restrict Hilltop's access.
We are not responsible for failures or changes in third-party services outside our reasonable control.
We will nevertheless take reasonable steps to maintain Hilltop and respond to issues affecting the service.
14. Availability and changes to Hilltop
We aim to provide a reliable service, but we do not guarantee that Hilltop will always be available, uninterrupted or error-free.
We may change Hilltop as the product develops.
This can include adding, changing or removing features.
If we make a change that materially affects the basis on which you use the service, we will try to give reasonable notice where practical.
15. Suspension and ending your use of Hilltop
You may stop using Hilltop at any time.
You can also ask us to close your account or workspace by contacting hello@usehilltop.com.
We may suspend or terminate access where reasonably necessary because:
- you materially breach these terms;
- use of the account poses a security risk;
- your use risks harming Hilltop, another user or a third party;
- we are required to do so by law;
- a third-party service Hilltop relies on prevents us from continuing to provide the service;
- we discontinue the early-access service.
Where appropriate and reasonably possible, we will give you an opportunity to remedy a breach before terminating access.
If Hilltop itself is discontinued, we will try to provide reasonable notice where circumstances allow.
16. Charges and future paid plans
Hilltop is currently provided without charge during early access.
We may introduce paid plans in future.
We will tell you the applicable price and payment terms before you incur any charge.
We will not convert a free early-access account into a paid subscription without making the charges clear and obtaining the agreement required to start that paid service.
Additional terms may apply to future paid or enterprise plans.
17. Responsibility and liability
Hilltop is provided with reasonable care and skill, but early-access software may contain errors and may change as it develops.
Because Hilltop is intended for professional and business use:
- you remain responsible for maintaining appropriate copies of your original media;
- you should not rely on Hilltop as your sole backup;
- you remain responsible for decisions made using AI-generated or other derived information;
- Hilltop is not responsible for the availability or integrity of your underlying Google Drive account or other third-party services outside our control.
To the fullest extent permitted by law, Hilltop will not be liable for:
- loss of profit, revenue or business;
- loss of anticipated savings;
- loss of goodwill;
- indirect or consequential loss,
arising from your use of the service.
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation, or death or personal injury caused by negligence.
While Hilltop is provided free of charge during early access, our total liability arising from or relating to the service will, to the fullest extent permitted by law, be limited to £100.
This limitation does not apply where applicable law does not permit liability to be limited in this way.
18. Privacy
Our Privacy Policy explains how Hilltop handles personal information, including information associated with Google Drive, AI processing and service providers.
The Privacy Policy forms part of the information governing your use of Hilltop but does not reduce any rights you have under applicable data-protection law.
19. Changes to these terms
Hilltop is an early-stage product, so these terms may change as the service develops.
We may update them to reflect:
- new or changed features;
- paid plans;
- changes to service providers;
- legal or regulatory requirements;
- changes to how Hilltop operates.
The date at the top of these terms shows when they were last updated.
If a change materially affects your rights or obligations, we will provide reasonable notice.
Continuing to use Hilltop after the change takes effect will normally mean that the updated terms apply to your continued use.
20. General terms
If part of these terms is found to be invalid or unenforceable, the remaining terms will continue to apply.
If we do not immediately enforce a provision of these terms, that does not mean we have waived our right to enforce it later.
You may not transfer your agreement with Hilltop to another party without our consent.
We may transfer the operation of Hilltop and these terms as part of a genuine transfer or reorganisation of the Hilltop business, provided this does not reduce your rights under applicable law.
These terms, together with any other terms we expressly agree with you, form the agreement relating to your use of Hilltop.
21. Governing law
These terms are governed by the laws of England and Wales.
The courts of England and Wales will have jurisdiction over disputes arising from or relating to these terms, subject to any mandatory rights that applicable law provides otherwise.
